Terms and Conditions – Xpress Deals

By using Xpress Deals, you agree to these Terms & Conditions. Vendors must also comply with the Vendor Rules included in this document (see point 7.1).

1. General Information

Xpress Deals is an online platform operated by Xtakes Marketplace SRL, VAT number RO52150108, headquartered in Iași, Romania (hereinafter referred to as “Xpress Deals,” “we,” or “the platform”), based in the European Union and holding a valid VAT number registered in VIES.

2. Role of the Platform

Xpress Deals operates as an intermediary connecting independent partners (vendors) with customers. We do not own, produce, or directly sell most of the offers listed on the platform, except for specific cases clearly marked as “Sold by Xpress Deals.”

Vendors are responsible for the accuracy, legality, and quality of their offers.

The platform facilitates transactions and may handle payment processing on behalf of vendors.

Vendors must operate within the European Union, Norway, Iceland, or Switzerland, and hold a valid legal entity with an active intra-community VAT number (VIES).

3. Applicable Law and Jurisdiction

These Terms and Conditions are governed by European Union legislation applicable to e-commerce. Any dispute will be resolved amicably, and if no agreement can be reached, it will be subject to the competent courts under EU jurisdiction rules.

4. Transactions and Payments

All transactions are processed in Euro (€). Payments are processed under the OSS (One Stop Shop) VAT scheme or the reverse charge mechanism where applicable. Payment methods include credit/debit cards via secure payment gateways (e.g., Stripe) and, in the near future, Mollie with split payment functionality. In cases where Xpress Deals is not the seller, payments are collected on behalf of the vendor and transferred according to the agreed terms.

5. Delivery and Performance of Services

Delivery times vary depending on the type of offer and the vendor, typically between 1–7 business days for physical goods or as specified for services and events. The vendor is responsible for delivering the purchased goods/services in compliance with their offer description.

6. Returns and Refunds

For offers sold directly by Xpress Deals, returns and refunds will be handled in accordance with EU consumer protection laws.

For offers sold by independent vendors, return policies will follow applicable EU laws and the vendor’s specific terms, which must be clearly stated in the offer description.

In all cases, the buyer’s statutory rights under EU legislation remain unaffected.

7. User and Vendor Obligations

Users must provide accurate personal and payment information. Vendors must comply with EU laws on consumer rights, taxation, and data protection (GDPR). The platform reserves the right to suspend or remove offers that violate applicable laws or these Terms.

7.1 Vendor Rules

• Only legal products, services, and events compliant with EU law and the vendor’s local legislation may be listed.
• Prohibited items include (but are not limited to): counterfeit goods, dangerous products, weapons, drugs, alcohol in countries where its sale is restricted, obscene or offensive material, and any item banned under EU or local laws.
• Vendors must hold the necessary rights or licenses for all images, trademarks, and copyrighted materials used in their listings.
• Standard commission is negotiated based on category and current policy.
• Violations, even without repetition, may lead to immediate suspension or account deletion without prior notice, but with subsequent notification.

8. Liability Disclaimer

Xpress Deals is not liable for the performance, quality, or legality of offers provided by independent vendors. Any claim related to a vendor’s product or service must be addressed directly to the vendor, except where Xpress Deals is the direct seller.

Liability is limited to the value of the transaction or €500, whichever is lower, except where mandatory EU law provides otherwise.

9. Privacy and Data Protection

Xpress Deals processes personal data in compliance with the General Data Protection Regulation (GDPR). For details, please refer to our Integritetspolicy and Cookie Policy.

10. Dispute Resolution

Disputes between buyers and vendors should be resolved directly between the parties. If no resolution is reached, Xpress Deals may, at its discretion, mediate the dispute but is not obliged to do so.

11. Account Termination

We may suspend or terminate accounts for violations of these Terms, illegal activity, or other actions that harm the platform or its users. Termination may occur without prior notice in severe cases, with a subsequent explanation sent via email.

12. Changes to These Terms

We reserve the right to modify these Terms and Conditions at any time. Any changes will be published on our website and will take effect from the date of publication.
